The KETTLE™ trademark is extremely valuable because it represents the standards of excellence and consistent quality associated with Kettle Foods. Consumers trust that KETTLE™ brand products will deliver the same great tasting product with each purchase as the KETTLE™ trademark serves to distinguished Kettle Foods products from others in the market place. The guidelines listed below contain detailed information about how to reference KETTLE™ trademarks in the event you wish to write about or mention KETTLE™ brand products. Referencing the KETTLE™ Trademark in Text
Consistent and correct use of the KETTLE™ trademark is very important. You may use the KETTLE™ trademark or KETTLE™ product names to refer to Kettle Foods products provided you follow the guidelines below.

1. Properly Identify KETTLE™ Brand Products
When referencing KETTLE™ brand products, always apply the appropriate trademark symbols in accordance with the list below.

The absence of a name or logo from this list does not constitute a waiver of any and all intellectual property rights that KFI has established in any of its product, feature, or service names or logos.

2. The KETTLE™ Trademark is a Proper Adjective and Must be Set Apart From Descriptive Product Terms Which It Modifies
The KETTLE™ trademark should always be capitalized. Always use the “TM” trademark symbol following KETTLE™. The appropriate noun, descriptor, or product name follows the KETTLE™ trademark. The KETTLE™ trademark may also be underlined, italicized, or bold. Any of the following examples are appropriate trademark usage.

Examples:

• KETTLE™ brand Potato Chips
• Kettle™ brand Potato Chips
• "Kettle™" brand Potato Chips
• Kettle™ brand Potato Chips

“Kettle Foods” does not need a ™, nor does it need to be distinguished with italics or bolding. This is the trade name of the company, not a trademark.

3. Never Use the KETTLE™ trademark in the plural or Possessive Form.

Correct: The taste of Kettle™ brand Potato Chips
Incorrect: Kettle’s taste

4. Never Use the KETTLE™ trademark as a Descriptor

Correct: Kettle™ batch-cooked chips
Incorrect: Kettle-cooked or Kettle-Style chips

5. When Possible, Identify Kettle Foods Ownership of the KETTLE™ Trademark in an Attribution Block.

Example:
“KETTLE™, KETTLE CHIPS™, and the KETTLE™ Chips design are trademarks of Kettle Foods, Inc. in the United States and/or other countries."

6. The Kettle™ brand Trade Dress
Kettle Foods owns all rights in the distinctive "look and feel" of its product configurations and packaging. This "trade dress" includes the unique style of all of its KETTLE™ products, its packaging, and the layout of its Web site properties. Kettle Foods considers its trade dress to be among its most valuable assets and prohibits others from using it except under express license. Kettle Foods appreciates your willingness to use the KETTLE™ trademark correctly.
